Yes, foreign nationals can buy property in North Cyprus. At the moment, property purchases from abroad are restricted to one per person. The process is fairly straightforward although it is always advised to seek support from a local real estate agent and legal representative.

  • Turkish Title Deeds: Issued for properties owned by Turkish Cypriots before 1974.
  • Exchange Title Deeds: Given to Turkish settlers for properties previously owned by Greek Cypriots.
  • Pre-1974 Deeds: Considered the most secure, as they refer to pre-intervention ownership by non-Greek Cypriots.

Stamp Duty and Property Tax

In North Cyprus, buyers must consider both stamp duty and annual property taxes. Stamp duty is a one-time fee, typically around 0.5% of the property’s value, paid by the buyer.

What are the Steps of Buying Property in North Cyprus

👉 Step 1: Reservation Agreement

Once you have found a property through a reputable real estate agent, then you are expected to sign a Reservation Form which includes the payment terms, and pay a deposit to your lawyer or estate agent. The amount of the deposit depends on the estate agent and on the agreement made with the seller. 

The deposit amount is included in the sales contract as part of the payment. The property is now reserved for the buyer at the agreed price for a period of two to three weeks until the buyer signs the sales contract and transfers the final payment. 

👉 Step 2: Due Diligence on the Property

The real estate agent or the buyer’s lawyer will perform due diligence on the property. They will make sure the Title Deed is in the name of the seller and that the property doesn’t have any outstanding encumbrances, mortgages, charges, liens or debt. The initial deposit will be refunded if there are any issues found in this step of the process. 

👉 Step 3: Power of Attorney 

A specialized property lawyer can proceed with the purchase on your behalf if you have signed a notarized Power of Attorney (PoA). With a PoA the buyer is not required to be present for every single step of the purchasing process. 

👉 Step 4: Sales Contract

The sales contract is then drawn up by the buyer’s lawyer or the real estate agent or a certified public notary. The contract will include all the terms and conditions agreed between the buyer and seller. Once the buyer is happy with the contract, it is signed in the presence of a public notary. 

👉 Step 5: Payments and Land Registry

After signing the contract, the buyer will have about two weeks to pay the first installment of the final payment. Within 21 days from signing the contract, the buyer has to pay the stamp duty and register the contract with the Land Registry. This registration is very important because it protects the buyer’s ownership rights. The seller will no longer be allowed to sell the property to a different buyer or get a mortgage on the property. 

At the point of contract registration with the Land Registry, the buyer is required to pay half of the Title Transfer Tax. The other half is due at the title deed transfer. 

👉 Step 6: Permission to Permit (PtP)

The buyer’s lawyer then moves on to applying for permission to purchase from the Council of Ministers. This step is unique to North Cyprus due to its political status. All non Turkish Cypriot buyers are required to do this and the Permission to Permit costs anything between USD 300 and USD 2,500. 

Applying for the PtP requires a photocopy of the buyer’s passport and a statement of the buyer’s criminal record which can be obtained from the buyer’s local police station. This must be an original copy. This process takes at least 6 months. 

👉 Step 7: Transfer of Title Deed

Finalizing the sale requires transferring the title deed, which includes payment of all taxes by the buyer and the seller. This ensures the buyer legally owns the property.

The seller pays the Capital Gains tax currently at 4% and the buyer pays Title Transfer Tax currently at 12%. Buying a new property will incur a VAT fee of 5% as well as connection fees. The VAT and expenses are not required for secondary properties unless the original owner has not paid VAT before.
